These Terms of Service ("Terms") govern your use of the Studio 440 website, booking platform, and services.
By accessing our website, purchasing services, or attending classes at Studio 440, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use our services.

Studio 440 Ltd. operates under the brand Studio 440.
2. Eligibility
Participants must be 18 years of age or older to attend classes unless accompanied by a parent or guardian and with written consent.
By purchasing services or attending classes, you confirm that:
you meet the age requirements
you are physically capable of participating in physical exercise
you have reviewed and accepted the required liability waiver
3. Studio Policies
All clients must comply with the Studio 440 Policies, which form part of these Terms.
These policies include but are not limited to:
class cancellation policies
waitlist policies
arrival policies
membership policies
studio conduct guidelines
photography and phone usage policies
Studio policies may be updated periodically and are available on our website.
4. Bookings and Purchases
Clients may purchase services including:
memberships
class packages
drop-in classes
private sessions
workshops or events
instructor training programs
retail merchandise
Bookings are managed through Studio 440’s booking platform and may require account creation.
You agree to provide accurate account information and maintain valid payment details.
5. Memberships
Memberships are governed by the Studio 440 Membership Agreement.
Key terms include:
memberships are non-transferable
memberships automatically renew unless cancelled in accordance with the agreement
membership payments are processed automatically using the payment method on file
Failure to maintain valid payment information may result in suspension of services.
6. Cancellation and Refund Policy
Class cancellations must follow the Studio 440 cancellation policy:
cancellations must occur at least 12 hours prior to class start time
late cancellations incur a fee
no-shows incur a fee and loss of class credit
Membership payments are generally non-refundable except where required by law.
Retail merchandise may be exchanged within 14 days if unused and accompanied by a receipt.
Grip socks are non-returnable for hygiene reasons.

7. Health and Safety
Participation in fitness activities carries inherent risk.
All participants must complete the Studio 440 Liability Waiver before attending class.
Clients are responsible for:
consulting a physician if they have medical concerns
informing instructors of injuries or limitations
exercising within their personal limits
Studio 440 reserves the right to refuse participation if safety concerns arise.
8. Photography and Media
Studio 440 may periodically capture photography or video within the studio for promotional or educational purposes.
By attending classes or events, you acknowledge that you may appear in studio-captured media.
If you prefer not to be photographed or filmed, please notify the Studio prior to class.
Personal filming or recording during class is strictly prohibited.
Unauthorized distribution of Studio 440 classes, instructors, or training materials is prohibited.
9. Intellectual Property
All content associated with Studio 440 including:
branding
logos
training materials
class programming
website content
photographs and videos
is the intellectual property of Studio 440 Ltd.
Content may not be copied, reproduced, distributed, or used without written permission.
10. Payments
All payments are processed through secure third-party payment providers.
By making a purchase you authorize Studio 440 and its payment processors to charge your payment method for:
memberships
class bookings
cancellation fees
retail purchases
other applicable charges.
Chargebacks or payment disputes may result in suspension of studio privileges.
11. Limitation of Liability
To the fullest extent permitted by law, Studio 440 Ltd., its employees, contractors, and instructors shall not be liable for any indirect, incidental, or consequential damages arising from participation in studio activities or use of the website.
All matters relating to physical injury or participation risk are governed by the Studio 440 Liability Waiver, which forms a separate legal agreement.
12. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein.
Any disputes shall be resolved in the courts of Saskatchewan.
13. Modifications
Studio 440 reserves the right to update these Terms at any time.
Updated Terms will be posted on the Studio 440 website with the revised effective date.
Continued use of our services constitutes acceptance of the updated Terms.
